Privacy Policy

 

The Sponsors, through the use of Airtable, are collecting the following information of individuals participating in the Competition: Participant’s name (and if Participant is a minor, Participant’s parent’s or legal guardian’s name); email; logo graphics files; and logo narrative (including a biography), which will be stored in a secure environment and will be used by the Sponsors for the sole purpose of managing the Competition.

This information is not being collected for commercial or marketing purposes1, and such information will not be sold, exchanged, or otherwise distributed for commercial or marketing purposes.

Participant’s submission of information for the Competition, however, constitutes the Participant’s express consent to the Sponsors’ use of all such submitted materials as part of promoting and documenting the Competition during and after the Competition in any media worldwide without payment or consideration. The Sponsors are not responsible for any subsequent third-party use of information that is publicized in connection with the Competition in this manner. In addition, disclosure of such information may be required pursuant to a request for records made under the Freedom of Information Law ("FOIL") or a court order, if such information is not protected by federal, or state, or local law.2

To request your personal information that has been collected and is being held, or to request removal of your personal information, please email contact@popslogo.nyc. Such removal during the Competition may result in disqualification.

Unless a Participant has elected to receive further information from the Sponsors about the Competition, including updates and announcements that will be sent using MailChimp, the Sponsors will not send such information.  Notwithstanding the foregoing, if a Participant is selected by the Panel to be an Awardee, and if an Awardee’s logo is chosen by the Department of City Planning to become the official New York City POPS logo, the Sponsors will notify such Participant. 

Children:  Participants must be eighteen (18) years old or older or obtain the written consent of any parent or legal guardian. The Sponsors do not intend to solicit information from minors or seek to determine whether a Participant is a minor. Consequently, because such information will not be specifically identified as being from minors, Participants should be aware that personally identifiable information submitted to the Competition by minors will be subject to being treated in the same manner as information given by an adult and may become subject to FOIL. 

The Sponsors may change this policy from time to time, and reserve the right to do so without notice.

1 Commercial and non-commercial marketing purposes include, for the purposes of this policy, Unsolicited Commercial Electronic Mail (colloquially known as "SPAM" e-mail), targeted e-mail for the purpose of selling products, or the sale or exchange of personally identifiable information between parties that anticipate receiving value in exchange for such information. References to promoting the Competition shall mean communicating information and updates about the Competition. Such promotion, on the Competition Website or the Sponsors’ websites or in other media, shall not be considered commercial and non-commercial marketing purposes under this policy.

2 Pursuant to Article 6 of NYS Public Officers Law 87, certain categories of records may be exempt from such disclosure under FOIL including, but not limited to, records whose disclosure would constitute an unwarranted invasion of personal privacy.
